Service Description
Albera Traducciones offers high-quality translation, editing, and interpretation services to meet your communication needs in different languages.
1. Purpose
These General Conditions (hereinafter, “the Conditions”) regulate the provision of translation, editing, and interpretation services (hereinafter, “the Services”) by Albera Traducciones (hereinafter, “Albera Traducciones”) to its clients (hereinafter, “the Clients”).
2. Scope of Application
The Conditions apply to all contracts for the provision of Services entered into between Albera Traducciones and its Clients.
3. Prior Information
Before contracting any Service, Albera Traducciones will provide the Client with the following information:
- Detailed description of the Services.
- Price of the Services, including taxes.
- Delivery time.
- Accepted payment methods.
- Cancellation and refund policy.
- Albera Traducciones contact information.
4. Contract Execution
The contract for the provision of Services shall be considered concluded at the time the Client accepts the Conditions and Albera Traducciones confirms receipt of advance payment.
5. Provision of Services
Albera Traducciones undertakes to provide the Services with the diligence and professionalism required, by the specifications agreed with the Client.
Meeting deadlines:
Albera Traducciones undertakes to deliver translation orders within the agreed deadline with the Client.
Late or out-of-scope delivery surcharge:
If Albera Traducciones cannot meet the agreed delivery deadline due to causes attributable to the company, a surcharge of 3% of the total order amount will be applied.
Exceptions to the surcharge:
The surcharge for late or out-of-scope deliveries will not apply in the following cases:
- Delays caused by the Client, such as late delivery of materials or requests for changes to the order after the translation start date.
- Cases of force majeure, such as natural disasters, strikes, or power outages.
Communication and transparency:
Albera Traducciones undertakes to maintain fluid and transparent communication with the Client throughout the translation process. We will periodically inform you about the progress of the order and notify you of any delays or changes that may affect the delivery date.
6. Prices
The prices of the Services are available on the Albera Traducciones website or will be provided to the Client upon request. The prices indicated include applicable VAT.
7. Payment Methods
Payment for the Services can be made in the following ways:
- Bank transfer (only for companies).
- Credit or debit card.
- PayPal.
- Bizum.
8. Delivery Time
The delivery time for the Services will be agreed upon between Albera Traducciones and the Client at the time of contracting the service. Albera Traducciones undertakes to deliver the Services within the agreed deadline.
If a delivery is requested on a non-business day or outside of regular business hours, the delivery date will be considered the next business day.
9. Cancellation and Refund
The Client may cancel the contract without any penalty if he/she communicates this to Albera Traducciones in writing at least 24 hours in advance of the date of commencement of the provision of the Services writing to info@alberatraducciones.com. In case of cancellation with less than 24 hours’ notice, Albera Traducciones shall have the right to retain 50% of the agreed price.
10. Liability
Albera Traducciones shall not be liable for any damages that may arise from the translation, editing, or interpretation of texts that are illegal, immoral, or contain confidential or protected information by intellectual or industrial property rights.
11. Confidentiality
Albera Traducciones maintains the confidentiality of all information that the Client provides within the framework of the provision of the Services.
12. Intellectual Property
Albera Traducciones maintains intellectual property rights over the services it offers. The client obtains a non-exclusive right to use the services for the specific purpose for which they were contracted. Albera Traducciones reserves the right to subcontract services to third parties that meet its same quality and confidentiality standards.
13. Force Majeure (continued)
Illness, accident or death of a family member:
Albera Traducciones may temporarily suspend the fulfilment of its contractual obligations if the translator or a member of his immediate team suffers a serious illness, accident, or death of a close family member. The duration of the suspension will depend on the specific circumstances of each case.
Notification to the Client:
Albera Traducciones will notify the Client as soon as possible of any force majeure event or personal circumstance that may affect the fulfilment of its contractual obligations. To the extent possible, Albera Traducciones will endeavour to find alternative solutions to continue the service or minimize the impact on the Client.
Exceptions to non-performance:
The exemption from liability for causes of force majeure or personal circumstances shall not apply in the following cases:
- The force majeure event or personal circumstance has been caused by the negligence or willful misconduct of Albera Traducciones.
- Albera Traducciones has not taken reasonable measures to prevent or mitigate the effects of the force majeure event or personal circumstance.
- The force majeure event or personal circumstance has been used by Albera Traducciones as a pretext to breach its contractual obligations without justifiable cause.
Communication and transparency:
Albera Traducciones undertakes to maintain fluid and transparent communication with the Client throughout the service provision process. We will periodically inform you about the progress of the order and notify you of any force majeure event or personal circumstance that may affect the fulfilment of our obligations.
14.Ex-post payment clause
The Client may request payment after the provision of translation services, provided that they notify the Provider of this request in writing to the email address info@alberatraducciones.com at least 5 calendar days before the start of the services. Failure to comply with this requirement shall be deemed as the Client having agreed to advance payment.
This payment method after the provision of services shall only be applicable to orders with a total value equal to or greater than €500.
In all cases, the provision of services shall require the signing of a commercial contract that shall detail the specific conditions of each transaction, including the services to be provided, prices, payment terms, deadlines, warranties, and liabilities.
The Client undertakes to pay the total amount of the invoice within a maximum period of 30 calendar days from the date of issue. In the event of late payment, the Client shall pay the Provider, as of right and without the need for any prior notice, a surcharge of 5% on the outstanding amount for each calendar day of delay, calculated from the day following the due date.
15. Applicable Law and Jurisdiction
The Conditions are governed by Spanish law. Any dispute arising in connection with the Conditions shall be resolved by the competent courts of the city of San Fernando (Cádiz).
